Painting in France Terms & Conditions
This contract is between Simon Roberts Illustration trading as Painting in France and the client.
Please complete the booking form and make payment as detailed.
By booking online you accept these terms and conditions on behalf of all members of your party.
All painting holidays include the following: Transfers to and from Beziers train station or airport | All accommodation | All continental breakfasts | All lunches, except lunch on free days – a mixture of restaurant meals and catered picnics including wine/beer and soft drinks | All evening dinners – a mixture of restaurant meals and catered dinners including wine/beer and soft drinks | All tuition | All entrance fees | All transport during the holiday | All materials and equipment
Holiday does not include activities and lunch on the free day, air transportation, airport taxes, transfers from anywhere apart from Béziers airport or train station, visas, health or accident insurance, trip cancellation insurance, optional activities not included in the final itinerary or items of a personal nature such as laundry, communication charges or purchases or any additional hotel or accommodation costs over and above lodging and breakfast.
The holiday starts from 16.00 on the day of arrival until 10.00 on the day of departure.
All payments must be made as per the details on the booking form. All bank charges / transfer fees must be paid by the client
Please note that the accommodation advertised may be exchanged for the accommodation of a similar standard. The client will be notified of this fact as soon as possible in these circumstances.
Cancellations
Cancellation Policy (only written notification by email or registered post can be accepted). The initial 35% deposit is non-refundable. II. After the balance has been paid, this amount is non-refundable.
In the case of a cancellation, Painting in France will do everything possible to resell the holiday. If this is possible all monies paid will be refunded less 100€ administration fee and any agents fees paid or any difference in the price achieved between the initial holiday price and the holiday price to the new clients (i.e. if a last minute discount is offered)
Should the holiday become unavailable due to unforeseen circumstances, a full refund will be made. The liability of the owner and their agents is strictly limited to the value of the booking.
Force majeure
Painting in France regrets that it cannot pay any compensation for cancellation or changes where the performance of the Contract or any changes to it is caused or affected by force majeure including war or threat of war, riots, civil strife, terrorist activity, industrial disputes, natural or nuclear disasters, fire or adverse weather conditions or other similar events beyond SBP’s control.
Insurance
The client is strongly recommended to arrange a comprehensive travel insurance policy, which includes cancellation cover for flights and accommodation and full cover for the party’s personal belongings, public liability, etc. Any losses are the responsibility of the client, not the responsibility of Painting in France or their agents. All accommodation must be kept locked at night and at any time it is left unattended.
This agreement releases Painting in France from all liability relating to injuries that may occur during the holiday. Payment of this holiday is an acknowledgment that, the client agrees to hold Painting in France entirely free from any liability, including financial responsibility for injuries incurred, regardless of whether injuries are caused by negligence.
I also acknowledge the risks involved in this holiday. I swear that I am participating voluntarily and that all risks have been made clear to me. Additionally, I do not have any conditions that will increase my likelihood of experiencing injuries while engaging in this activity.
By booking, I forfeit all right to bring a suit against Painting in France for any reason. In return, I will receive painting tuition or guided activities I will also make every effort to obey safety precautions and as explained to me verbally. I will ask for clarification when needed.
It is advised that the client take additional breakdown and motor insurance if on a self-drive holiday.
Swimming Pool
Painting in France, the owner and their agents accept no liability or responsibility whatsoever for any accident in its properties, their grounds or swimming pools. Children MUST be supervised at all times.
General
The owners and their agents shall not be held responsible for:
l. Any temporary defect or stoppage in the supply of public services to the accommodation, or in respect of any equipment, machinery or appliances in the property or garden.
II. Any loss, damage or injury, which is a result of adverse weather conditions, riot, war, strikes, or other matters beyond the owner’s control.
III. Any loss, damage or inconvenience caused to or suffered by the client if the accommodation is destroyed or substantially damaged before the start of, or during the rental period.
If the client fails to notify Painting in France of any problems or dissatisfactions prior to departure from the accommodation, it is deemed that the client is satisfied and therefore has no case for redress.
The client is expected to act in a manner that would not cause unacceptable disturbance to residents in neighbouring properties.
No smoking is allowed inside the accommodation. Outside please ensure all cigarette butts are cleared away.
These terms and conditions are in place to maintain a high standard and to keep the administration process as simple and efficient as possible.
